Works closely together with Brian Webber handling commercial and corporate work for clients ranging from private individuals and small business to large companies, including listed companies and international corporations. His position involves the attendance of consultations and negotiations for the purpose of structuring business deals. This includes the drafting and review of agreements relating to, amongst others, mergers and acquisitions, sales of and options on shares, joint ventures, distribution and licensing agreements involving intellectual property for both tangible and intangible product/services, international transactions, competition law advice in respect of all transactions that fall under the Competition Act as well as the preparation and submission of Merger Notices to the Competition Commission, commercial liquidations, telecommunications agreements and franchising. In addition, the firm acts for a number of companies listed on the Johannesburg Stock Exchange as well as other international stock exchanges and he is involved with such companies in respect of all stock exchanges related issues.
He has been involved with the setting up of joint ventures and ancillary work like registering companies, conducting any legal due diligence, etc. He has been involved with general negotiations in respect of commercial transactions and, where necessary, brokering deals and putting people together. Attending to conduct research and provide written opinions to clients in certain instances.
As an off-shoot of his commercial and corporate work he has also gained experience in the field of commercial litigation and, especially, liquidations, business rescue and insolvency. He has also been involved in turn around management and business rescue, which involved the complete restructuring of various entities, including subsidiaries. He was also appointed to the Board of the Turn-Around Management Association of Southern Africa (TMA-SA) in November 2012.
Another aspect of his work entails advising and training companies on the Consumer Protection Act and Competition Act. He works closely with the working closely together with ASATA and is largely responsible for drafting the industry codes for the travel industry.
Gareth has also assisted in drafting amendments to the Tobacco Act.
