“We post a list of guilty verdicts on our website monthly which the public can access to see whether a practitioner has been found guilty of misconduct. The details include which practitioner has been charged and the nature of the offence. In addition, members of the public can call our call centre on (012) 338-9300 to check whether a practitioner has a complaint pending or a prior record,” said HPCSA Registrar, Adv. Boyce Mkhize.
In terms of the sentences meted out, every case is treated according to its merit. Currently, legislation limits the penalties which the committee hearing an enquiry can execute. However, the new Health Professions Bill will see improved guidelines for penalties which will be commensurate with offences. The Bill also proposes that a lay person chair these hearings to further ensure transparency.
“We are committed to ensuring that public is protected by dealing with complaints as quickly as possible, and practitioners not adhering to set guidelines are disciplined appropriately. This safeguards not only the public, but also assures the overwhelming majority of healthcare practitioners who do adhere to the strict ethical guidelines we have laid down that that no unqualified person may practice and that unethical practitioners will be brought to justice,” said the Registrar.
